Terms of Service

Effective date: 31 March 2026

1. Introduction and Parties

These Terms of Service (“Terms”) govern your use of timply.io, operated by Smart Media Projects (“we”, “us”, “Timply”), registered in Amsterdam, Netherlands (KVK 70766088).

By creating an account or using the service, you (“you”, “the customer”) agree to these Terms. If you are using Timply on behalf of an organisation, you confirm that you have authority to bind that organisation.

2. Service Description

Timply is an AI-powered email template management platform. You can create, edit, translate, and organise email templates. AI features are powered by third-party language models.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • One account per person. You are responsible for keeping your login credentials secure.
  • We may suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Pricing

  • Available plans and pricing are listed on our pricing page.
  • Plans may change. Existing subscribers will receive at least 30 days notice before any pricing change takes effect.
  • All prices exclude VAT unless stated otherwise.

5. Payment Terms

  • Subscriptions are billed monthly or annually via Stripe.
  • Payment is due at the start of each billing period.
  • If a payment fails, we will retry. After repeated failures, we may downgrade or suspend your account.

6. 14-Day Money-Back Guarantee

If you are not satisfied, you can request a full refund within 14 days of your first subscription payment. Contact support@timply.io to request a refund.

7. Cancellation and Termination

  • You may cancel your subscription at any time. You will retain access until the end of your current billing period.
  • No partial refunds are given for unused time, except under the 14-day money-back guarantee.
  • We may terminate your account for violation of the acceptable use policy.
  • Upon termination, you have a 30-day window to export your data. After that, your data will be deleted.

8. Your Content

  • You own all templates and content you create or import into Timply.
  • You grant us a limited licence to process your content solely to provide the service, including AI-assisted editing.
  • We do not claim ownership of your content.
  • We do not use your content to train AI models.

9. AI Features Disclaimer

AI-generated and AI-edited content is provided as a starting point. You are responsible for reviewing all AI outputs before using them. We do not guarantee the accuracy, legal compliance, or deliverability of AI-generated content.

10. Acceptable Use

You agree not to:

  • Use Timply to send spam, phishing emails, or illegal content.
  • Attempt to circumvent usage limits or access controls.
  • Reverse-engineer, decompile, or disassemble any part of the service.
  • Use the service to build a competing product.

11. Intellectual Property

The Timply platform, branding, and underlying code are owned by Smart Media Projects. Your content remains your property, subject to the limited licence described in section 8.

12. Limitation of Liability

  • Our total liability is capped at the fees you paid in the 12 months preceding the claim.
  • We are not liable for indirect, consequential, or lost-profit damages.
  • The service is provided with reasonable skill and care, but we do not guarantee uninterrupted availability.

13. Data Processing

We process your data as described in our Privacy Policy.

If you are a data controller (for example, processing your own customers' data in templates), we act as a data processor on your behalf. Sub-processors are listed in the Privacy Policy. We will notify you of any sub-processor changes with at least 30 days notice.

14. Third-Party Services

Timply relies on third-party services including Stripe (payments) and Google Gemini (AI). We are not liable for outages or issues caused by these third-party providers.

15. Changes to These Terms

We may update these Terms from time to time. We will give at least 30 days notice of material changes via email. Continued use of the service after the notice period constitutes acceptance. If you disagree with the changes, you may cancel your subscription before they take effect.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved by the competent court in Amsterdam.
